Professional Discipline Defence Lawyer
Your professional reputation took years to build—we help ensure it isn't lost in a moment.

We recognize how regulatory matters threaten both your livelihood and your identity.
Professional Discipline in Alberta
Professional discipline matters are specialized proceedings that can threaten your ability to practice your profession. In Alberta, regulated professions operate under various governing bodies with the authority to investigate complaints, impose sanctions, and even revoke licenses to practice.
These proceedings differ significantly from criminal cases, with unique procedural rules, standards of proof, and potential consequences. Even allegations alone can damage your professional reputation and career prospects, making effective legal representation essential from the earliest stages.
We understand the complexities of professional discipline cases and their potential to impact both your professional and personal life. With our experience on both sides of the legal system, we develop comprehensive defence strategies tailored to your profession, the specific allegations, and the governing regulatory framework.

Obtain and Review the Complaint File; Respond to Investigative Inquiries
The first step when someone is being investigated is to find out exactly what regulatory body is investigation - that is to say, the specific allegations that constitute the alleged breach of professional standards.
Once we obtain this information, we sit down with you to prepare for the investigation portion of the proceedings. Often, there will be a request for a written response and then a virtual or in-person interview. We help you prepare for both.
Resolve or Proceed to Hearing
After the Investigative Phase is complete, the Investigator makes a recommendation to either dismiss the complaint or proceed to a hearing.
If the complaint proceeds, the Hearing Director (or their legal representative) may offer a resolution that we will discuss with you. If the matter cannot be resolved in a way that you find satisfactory, we will prepare for the Disciplinary Hearing, which is like a court hearing in front of the regulatory body, but with some different rules.
Prepare for Hearing
We prepare you and any witnesses for the hearing by thoroughly explaining how proceedings will look, showing you around a similar hearing room so that you feel comfortable, asking you practice questions so that you get used to speaking in public, and doing mock cross-examinations so that you are not flustered when answering questions.
Hearing
At the hearing, we mount your best defence so that you are protected in your professional role.

Contact a lawyer experienced in professional discipline matters immediately before responding to the complaint. Early legal intervention can significantly impact the direction and outcome of disciplinary proceedings. We can help you craft an appropriate initial response that protects your interests.
In most cases, you can continue practicing while under investigation. However, some regulatory bodies may impose interim practice restrictions or conditions during serious investigations. We work to minimize any practice disruptions while your case is pending.
Outcomes range from dismissal of complaints to reprimands, remediation requirements, practice conditions, suspensions, or in the most serious cases, license revocation. We work toward achieving the most favorable outcome that allows you to continue your professional practice.
Timelines vary significantly depending on the complexity of allegations, the regulatory body involved, and whether hearings are required. Some matters resolve in months, while complex cases may take over a year. We work efficiently to minimize both the duration and professional impact of proceedings.
Professional discipline proceedings operate under different rules, standards, and procedures than civil or criminal matters. While criminal cases require proof beyond a reasonable doubt, professional discipline typically uses a lower "balance of probabilities" standard. Additionally, these proceedings focus specifically on professional standards rather than broader legal violations.
